WA’s land tenure laws set to be overhauled to unlock millions of hectares for renewable hydrogen projects

Huge swathes of Crown land that’s unused or under pastoral lease is set to be unlocked for “green hydrogen” projects across WA. Currently, WA’s Lands Administration Act only permits millions of hectares of State Government-owned land to be used for grazing livestock. A new form of land tenure, known as a diversification lease, would allow wind and solar farms needed for hydrogen production to “co-exist” with other land activities and rights. Under the reform, leaseholders could potentially also pursue carbon farming or horticulture projects, while traditional owners could access land to develop cultural tourism businesses. Sites could also be opened for conservation organisations to preserve or rehabilitate biodiversity, the McGowan Government said. The amendments include the ability to extend lease terms to 50 years, subject to complying with Native Title agreements, in a bid to allow pastoral lessees to plan for the longer term. “Global demand for clean energy is increasing and Western Australia will be better placed to capitalise on this demand under these updated land tenure rules,” Lands Minister Tony Buti said. “Under these changes to the Lands Administration Act we can establish a diversified and resilient economy, create new long-term job opportunities and reduce reliance on fossil fuels to power remote communities. “Importantly, we can also give Aboriginal groups a real opportunity for economic development on their traditional lands.” The proposed changes come after mining magnate Andrew Forrest recently said red tape meant his first hydrogen investment would be based in Queensland, not WA. Fortescue Future Industries, the renewable energy arm of Mr Forrest’s business empire, on Wednesday said it looked forward to analysing the detail of the announcement. “Fortescue Future Industries is a strong advocate for tenure reforms to harness the significant renewable energy and green hydrogen potential for Western Australia,” a spokeswoman said. Province Resources, which is developing the HyEnergy Project near Carnarvon, said it was pleased the Government had responded to the needs of industry. “These are important reforms which will support the development of the green hydrogen industry in WA,” Province chief executive David Frances said. “We believe green hydrogen developments can benefit traditional owners, pastoralists and the broader community while at the same time providing an important source of clean energy to the world. “A clearer pathway towards land tenure for green hydrogen projects will be important in providing greater confidence for proponents to invest in these developments.”
