Khizar Hayat pleads guilty to desecrating sacred Sikh text, Gutka Sahib, and uploading footage to TikTok

Members of the Sikh community want tougher penalties for faith-based hate crimes after it emerged a man who posted footage of himself on TikTok desecrating a holy book may escape with just a fine. More than 50 people attended Armadale Magistrates Court on Friday, calling for changes to be made to the Racial Vilification Act as Khizar Hayat pleaded guilty. The 21-year-old made several videos showing himself throwing the Gutka Sahib, a sacred text for SIkhs, on the ground outside the Canning Vale Gurudwara on August 27, stepping on and kicking it outside his home, tearing out pages then flushing them down a toilet as well as burning them. He uploaded the videos to TikTok where they quickly went viral, sparking international outrage and protests on the streets of Melbourne earlier this month. The incident was widely condemned, with the Sikh Association of WA and the Hindu Council of Australia saying it was the first such incident in Australian history. After pleading guilty to one count of intending to racially harass, Hayat, who has been on remand at Hakea Prison, was granted strict bail on a $10,000 personal undertaking. He was also banned from using social media, ordered to report to police daily, abide by a 6pm to 6am curfew and not leave Australia. He will be sentenced next month. Outside court, Maninderjeet Singh, a Sikh community spokesman, told The West Australian that there was still a lot of anger and hurt in his community by what Hayat had done. He explained that the Gutka Sahib is more than just a sacred book to the Sikh community; it is a living Guru who is worshipped above all else. “We bow down to it every day,” Mr Singh said. “We put it in a room with air conditioning, and we treat it like a king. When the guru arrives, we play the drums. We have flags, our own religious flags of the Sikhi. So, this is the importance that we give to the words. We don’t even let any sort of dust settle down, and we keep it as clean as possible. It’s always on a higher level from the ground. “So, this is the amount of respect we pay to our guru. So, maybe in some religions, the books don’t have that much value, but within Sikhism, they have the utmost respect.” Mr Singh said the community was concerned Hayat would only be fined for what he did, saying they believed he should be jailed. He said they had pushed for him to be charged with other offences and wanted his matter moved to the District Court, where the penalties are higher. “This person should be sentenced to maximum imprisonment or should be deported as well if they are not a part of this country if they are not a citizen here,” Mr Singh said. “I think we would fail as a society if these sort of individuals are let out again. How do we know he won’t commit these sorts of offences again? “We would like to push for stricter sacrilege laws so these sort of individuals are not let off with a slap on the wrist.”
