Jaxson James Stewart avoids jail after punching and kicking police officer at Sunset Beach home

A 34-year-old construction worker who assaulted a police officer last year has avoided jail after learning his fate in Geraldton Magistrate’s Court on Wednesday.

Jaxson James Stewart was fined $4000 for kicking and punching a policeman at a Sunset Beach house in the early hours of November 11.

The court was told police were called to the home at the request of Stewart’s partner, who wanted him removed from the property.

When officers tried to issue a police order Stewart lashed out in anger and kicked one of the officers in the chest.

Prosecuting Sgt Beau Jones said Stewart also punched the same officer when police tried to arrest the 34-year-old.

“The officer sustained a cut to his lip and a loose tooth and attended Geraldton Regional Hospital,” he said.

While Stewart admitted to kicking the officer, defence lawyer Kate Fry said her client maintained he did not punch anyone.

Sgt Jones said Stewart was arrested and brought to the Geraldton Police Station lock-up area, where he fought with officers again.

“The accused kicked the lock-up keeper in the right forearm, banging it against the lock-up door frame,” he said.

Stewart spent 33 days in custody following the attack. He was fined $2000 for obstructing police in the lock-up.
