Sarah-Jane Tasker: Woodside’s Scarborough court rejection will have broader implications for future projects

Woodside was kicking goals one day and then benched by a court decision the next, in a move that could have broader implications for future gas projects in WA. The day after the energy giant revealed it had re-signed its sponsorship deal with the Dockers, Justice Craig Colvin blocked seismic work at its $17 billion Scarborough gas project. He ruled that the Federal environmental regulator invalidly exercised its powers when it gave Woodside the green light to start the work. Indigenous woman Raelene Cooper launched the court action after arguing that the company had failed to adequately consult with her as required. As one industry body warned, companies following the rules, consulting in good faith and gaining regulatory approvals are now having the goalposts shifted. It’s not the first time a court ruling has overturned regulatory approval of a gas project. Woodside has said that since June 2018 it undertook 82 substantial engagements relating to Scarborough, including 32 meetings with traditional custodians and their representatives. Justice Colvin said that was not enough. What would have been enough? The world needs to transition from higher-polluting fuels to greener, renewable, options. That is not in doubt. But it’s a simple fact that gas has an important role to play in that transition. The court’s decision will throw a cloud over other environmental approvals before the regulator and could impact much-needed future production.
